Extra Details: The series was removed from FOX's schedule and subsequently canceled after the fifth episode. They were eventually made available in the US with the Complete Series DVD in November 2012. As such, episodes 6-13 have been moved to the newly-created Specials season.

I understand this is the rule for "unaired" episodes, but just because they weren't aired in the US, doesn't mean they're "unaired?
Wikipedia indicates that episodes 6 - 13 aired in Portugal on their weekly schedule before they were ever released on DVD.

This is a US show and the episodes did not air on FOX so, yes.
Portugal is not the Origin Country for this show so the fact that they aired the episodes after FOX canceled the show doesn't matter; FOX did not air the episodes, which is why they are in the Specials season.
