...one level higher into real person? they just need to get killed? that would be pretty big flaw for users and considering in highest level it looks like ordinary mainstream device that could not be released to market so there must be some other way

I'm not sure what you're saying here, but as far as I can remember, having watched this at least a few times, there are no "real" people. The simulation exists inside a simulation.

Yep, it's just a bad lame movie. There are many great movies about AI discussing if AI could be alive. This movie touches this subject but doesn't even try to discuss it. It's just "AI/NPCs on the simulation are alive and have soul, and if their user die inside the simulation they get free and take their user body".

The film ends with the screen turning off like a computer monitor, suggesting that the final world we see is also a simulation. This thus suggests that the world above that one could also be a simulation and so on and so on continuously. We don't really know how many simulations there are.
