Extra Details: Hi all, TMDB is only refering to the 6 episodes of the original BBC production. International (at least in germany) there are 8 episodes available, see here:

On top of that, a scraper set to german language is receiving all 6 episode descriptions in english language.

In terms of the number of episodes, we only support the original number and order. As for the scraper, you'll have to look into your specific scraper and their support, the data is good on our end.

If that is the case, it would be fine in most cases. IMDb also claims Copyright on overviews, but in some cases someone would just add the overview from the official website to IMDb. In such cases it is almost always fine to add the overview here. But how does that work in Germany?

The overviews are from fernsehserien.de also as you can see there, and even the original overviews from the tv sites have a copyright in Germany that's not kidding

Yes, I remember you wrote that before and we have already decided to go the safe route with German content (decision by Travis). I just wonder if not someone should try to report Fernsehserien to the authorities in Germany. It would be interesting to find out if they are bluffing with regards to their own copyright. I mean they would have to pay for the rights from the official site?

Maybe Travis can ask them if it is okay to use their texts here?

Hi all, I already wrote a mail directly to "ard.de", the owner of the content, and asked if not only "fensehserien.de" is allowed to use their official text, but also TMDB. Let's wait for the reply.

And Samara, I agree that it's of course not allowed to C&P each and everything. But your link includes a looong explanation for all digital content: Videos, pictures, music, grapics and text** in the sense of literature*. TMDB doesn't offer **any of these content*, neither video- nor audio-files; and description of movies or series are not treated as literature. It's a quote, and that's the difference!

And that's exactly what Fernsehserien did! They quoted the original description from the producer, the NDR.de (Norddeutscher Rundfunk)! And they are right...

But anyway, I already spent 2 hours of my time last weekend to add content, and I won't do all the work again. Think about pressing the "delete"-button more carefully next time!

No sorry your link is not correct for the content here, it's not quoting if you use the whole text from another site, I think you know what a quote is a quote is a piece of text not the whole text and fernsehserien.de has a impressum where you can read that they forbid to use their content on other sites without their permission ( and by the way the copyright owner for tv series is much more difficult to know, it's not only the tv station there are many more)

and from your link: Man darf also nicht einfach jedes Stück Text in jeder Länge in einen eigenen Text einbauen: Der Ausschnitt muss einen Zweck erfüllen, indem er zum Beispiel den Inhalt des neuen Textes erläutert Eine strikte Grenze, wie lang ein Zitat sein darf, gibt es nicht. Jedenfalls ist der Zitierende nicht verpflichtet, sich nur auf das notwendige Minimum zu beschränken. Zulässig sind Zitate vielmehr in einem sachgerechten, vernünftigen Umfang. If I understand it correctly, you need the explicit permission from ARD to use their texts for tv shows/movies (= Metadaten and Begleitmaterial) before you can use them under their terms. I don't think it qualifies as "quoting" if you use more than a few words - meaning, those texts are protected by copyright rules and you're not allowed to use them.

But I'm not a lawyer, and such texts are always gibberish, even in my native language. leopard

Es gibt für die Verwendung der Programmdaten allgemeine Geschäftsbedingungen der ARD. Wenn Sie die akzeptieren (unterschrieben zurückschicken) und uns noch ein bisschen mehr darüber verraten, was genau Sie mit den Daten machen wollen (Sie dürfen sie z.B. nicht verändern ...), können Sie sie verwenden.

Nota Bene: Vergleiche zur fernsehserien.de sind nicht stichhaltig. Die Kollegen, die die Website betreiben, haben ihrerseits Lizenzvereinbarungen mit Zulieferern getroffen. Eine Weiterverwendung zu nicht-privaten Zwecken ist nach meinem Kenntnisstand nicht zulässig.

Ich bitte die verspätete Antwort zu entschuldigen, so liegt sie zumindest noch unter dem Weihnachtsbaum.

I think the message confirms exactly what Samara wrote earlier:

  1. TMDb is not allowed to use the data from fernsehserien.de.
  2. If TMDb wants to use the data directly from ARD, you need their explicite permission to do so, because of the copyright.

And point 2 means: Every single time you want to use a text or something else, you have to ask them or look at their website if you're allowed to use this specific piece. I don't know - that sounds way too complicated and would probably lead to so much more extra work. I don't think that's practical ... worried
